Last month an extension was given to the minister, the final decision is now expected on the 16th of August

As Brekel noted the decision has been deferred another 40 business days which takes it to October 12.
The proponent is notified 10 business days prior to that and is afforded some time to respond before the draft decision is made public.

Everyone associated with the campaign is frustrated at the length taken to assess the information but we hold hope the Minister or their delegate are using this time to properly read the 5300 public submissions against this thing and assess it properly.

For those that have followed along they would be aware the project was never given and decent scrutiny by the state. Hopefully the Feds do the job the state failed to do.

They can postppone it until the Twelfth of Never as far as I'm concerned. One of those "permanent stays of action" certain institutions are so fond of when they get caught out. No decision means nothing gets built and the place is safe.

TWS and TNPA have commenced legal proceedings to wind up Wild Drake Pty Ltd

“The final stage of many legal proceedings is the awarding of costs. In this case the Full Court of the Supreme Court, in September 2021, ordered the respondents to the Appeals (Wild Drake and the Director of National Parks and Wildlife) to pay the Appellants’ legal costs. Following a protracted dispute over the amount of the costs, an agreement was made in September 2023 which required full payment by 17 November 2023 …

“The Appellants then sought legal advice on our options for recovering the debt of $19,500. We were not prepared to abandon any opportunity to recover the debt, so we instructed our lawyer to issue a statutory demand which required payment by 1 May 2024. A payment of $1,500 was made on 4 June 2024, accompanied by a promise to pay the balance of the debt ($18,000) in full by 17 July 2024. By 30 July 2024 no further payment or communication had been received from Wild Drake so we have commenced proceedings to wind up Wild Drake so that a liquidator can be appointed to recover our debt. The Court documents were served on Wild Drake Pty Ltd on 9 August 2024.”

I'd assume it's the previous one as the order was made in 2021..

When I first read the article, I thought it was Jacobi, but then I re-read it and realised it was James Findlay. I'm a little disappointed as this whole saga has Jacobi's fingerprints all over it, yet he's walking away like it had nothing to do with him :(

If Wild Drake cannot or will not pay then the Director of NP may have to pay. While Jacobi may have been at fault and there may be possible legal actions to recover costs from him - it was on his watch - this is unlikely. He made at least two errors of judgement. The Wild Drake plan was without merit, and he did not see that there was solid widespread opposition to the plan, backed by science, and a bit later, laws.

This seems to be an excellent summary. And if the logical outcome occurs, it would appear to be a completely justified one.

If you read the attached statement from TNPA in full, you'll note that the Director of National Parks and Wildlife paid his agreed amount in full by the due date. It's just WIld Drake that hasn't paid their share yet.

Mhm, the weather forecast looks not so great but we're holding in hope of some sun at some stage... We've done this trip twice in the past, I have very fond memories of waist deep water first thing in the morning or falling in a hidden bog hole.

We're coming in from the north I guess (from Triangle Lake). As a side note if anyone has any useful info about an approach from this way, my pms are open! We've kind of just levelled with the fact it's probably going to be not so pleasant.

Chinaman's Plains is mostly easy walking (if the weather is nice). Our route from Malbena to Meston is illustrated here: viewtopic.php?f=42&t=29114&p=367295&hilit=malbena#p367295

The scramble up from Malbena onto the plains was quite steep and scrubby, and I would use a different route at the North end, approaching Meston, as that was quite scrubby too. But most of the plains was open and easy walking. Lot's more information on the conditions we encountered are also included in that thread.

Thanks mate. Yes, we've also clambered down to Meston twice just north of the lake, lots of tea tree to contend with. Looks like you guys had a great time!

Between Triangle and Malbena, it's easy enough, just lots of dodge and weave. It's getting up to Triangle that will be "fun". I've been down three times on various lines and it always gets nasty at some point.
There's a more circuitous but very open route to Triangle following leads from near the base of Lake Ball, if you can get over the Pine River. Then Triangle to Kita, around to Kita's south side and try to find the illegal cut from there to Malbena.
The lumps in that area aren't as scrubby as they may look from a distance - it's mostly light, open woodland over rock slabs. Just keep away from the fagus copses.

Still, it's good to have this finally hit the news. Although: "Daniel Hackett, of Wild Drake, said the Commonwealth approval process would continue.
"We're still engaged in the federal process and committed to the project," he said."
