Most brands are horrified to hear such a problem and are certainly not expecting it, therefore will be more than happy to comply to a refund or credit.
On a side note, the lead guide at the company I work for told me of his constant problem with boots falling apart. He said he'd been in to see a boot maker who explained that almost all bushwalking boot soles are at risk of delamination in Tasmania, due to our peat/acidic soils. Interesting point, I don't have any further evidence to suggest such things but it might make sense.
